Terms and Conditions

1.1. "Platform" refers to CellUp's mobile application and any related services provided.

1.2. "User" refers to any individual accessing or using the Platform.

1.3. "Device" refers to electronic gadgets, including but not limited to mobile phones, laptops, tablets, and accessories.

1.4. "On-site Engineer" refers to the authorised personnel responsible for evaluating and inspecting Devices.

2.1. Eligibility: Users must be at least 18 years old and reside within India.

2.2. Registration: Users must register using a valid mobile number. Verification is conducted via a One-Time Password (OTP).

2.3. Account Information: Users are responsible for providing accurate and up-to-date information, including bank account details for refunds.

2.4. Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities under their account.

3.1. Buying: Users can purchase Devices listed on the Platform. All purchases are subject to availability and are sold on an "As-Is" basis.

3.2. Exchange: for now the exchange is not available but will be available soon

4.1. Evaluation Process: Devices submitted for sale or exchange will be evaluated by our On-site Engineer to assess their condition and determine the price.

4.2. Evaluation Criteria: Evaluation considers factors such as Device functionality, physical condition, and accessories.

4.3. Discrepancies: If the Device's condition does not match the User's description, the evaluated price may be adjusted, or the Device may be rejected.

4.4. Acceptance: Users agree to accept the evaluation results, including any price adjustments or rejections.

5.1. Pricing: Prices for Devices are determined based on evaluation and current market conditions.

5.2. Payments to Users: For sold Devices, payments will be credited to the User's registered bank account the same day on after acceptance.

8.1. Accurate Descriptions: Users must provide truthful and accurate descriptions of their Devices.

8.2. Legal Ownership: Users must have legal ownership and the right to sell or exchange the Devices they list.

8.3. Prohibited Items: Users must not list counterfeit, stolen, or illegal Devices.

8.4. Compliance: Users must comply with all applicable laws and regulations.

9.1. CellUp is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform.

9.2. CellUp does not guarantee the continuous availability of the Platform and may suspend or discontinue services without prior notice.

10.1. All content on the Platform, including text, graphics, logos, and software, is the property of CellUp and protected by applicable intellectual property laws.

10.2. Users are granted a limited, non-exclusive license to access and use the Platform for personal purposes.

10.3. Unauthorized use of the Platform's content is prohibited.

12.1. CellUp reserves the right to suspend or terminate a User's account for violations of these Terms or any applicable laws.

12.2. Users may terminate their account by contacting customer support. Termination does not absolve Users of obligations incurred prior to termination.

13.1. These Terms are governed by the laws of India.

13.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in J&K, India.
