1. Agreement to Terms

By accessing or using Cellup's mobile application and website to sell your smartphone, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our services.

Important: Cellup is a smartphone buying service. We purchase smartphones from customers. We do not sell any products. All transactions involve you selling your device to us, and we paying you instant cash.

We reserve the right to modify these Terms at any time. Your continued use of our services after such modifications constitutes your acknowledgment of the modified Terms.

2. Eligibility and Account Requirements

2.1 Eligibility

  • You must be at least 18 years old to use our services
  • You must be the legal owner of the device you are selling
  • You must have the legal right to sell the device
  • You must provide accurate and truthful information
  • You must have a valid bank account for receiving payments

2.2 Account Security

  • You are responsible for all activities under your account
  • You must maintain the security of your account credentials
  • You must notify us immediately of any unauthorized access
  • You must keep your contact and bank account information up to date

3. Device Sale Process

3.1 Service Area

  • Currently available in Srinagar, Jammu and Kashmir
  • Home pickup service available for 20+ pincodes
  • Pickup service available 7 days a week, 9 AM to 6 PM
  • Free pickup service - no charges to you

3.2 Device Listing Requirements

  • You must provide accurate device information including model, condition, and specifications
  • You must disclose all defects, damages, or issues with the device
  • You must provide clear photos showing the actual condition of the device
  • You must provide the correct IMEI number and serial number
  • False or misleading information may result in transaction cancellation and legal action

3.3 Device Verification

  • Our pickup agent will verify the device condition upon collection
  • We will verify IMEI number against stolen/lost device databases
  • We will verify device ownership through government-issued ID
  • We reserve the right to refuse purchase if device condition doesn't match your description
  • We reserve the right to refuse purchase if device is reported stolen, lost, or locked
  • We reserve the right to refuse purchase if you cannot prove ownership

4. Pricing and Payment

4.1 Price Determination

  • Price is determined based on device model, condition, age, and market value
  • Initial quote is based on information you provide in the app
  • Final price is determined by our agent after physical verification
  • Price may be adjusted if actual condition differs from your description
  • We reserve the right to reject the purchase if condition is significantly different
  • All prices are final once payment is transferred

4.2 Payment Terms

  • Payment is made via instant bank transfer to your registered bank account
  • Payment is processed immediately after device verification and collection
  • You must provide accurate bank account details (account number and IFSC code)
  • We are not responsible for payment delays due to incorrect bank details
  • All payments are in Indian Rupees (INR)
  • Transaction is final once payment is transferred - no returns or refunds

4.3 NO RETURNS POLICY

IMPORTANT: Once we purchase your device and payment is transferred, the transaction is final and irrevocable. We do not offer returns, refunds, or buyback options. You cannot request the device back after sale completion.

5. Fraud Prevention and Penalties

5.1 Prohibited Activities

  • Providing false or misleading device information
  • Selling stolen, lost, or unauthorized devices
  • Selling devices that are not legally owned by you
  • Attempting to sell locked, blacklisted, or blocked devices
  • Providing false identity or ownership documents
  • Attempting to defraud or deceive our verification process
  • Interfering with our pickup or verification process

5.2 Consequences of Fraud

  • Immediate cancellation of transaction
  • Permanent ban from using our services
  • Legal action including filing police complaints
  • Reporting to law enforcement authorities
  • Sharing information with device manufacturers and fraud prevention agencies
  • Blacklisting of your account and associated phone numbers
  • Pursuing civil and criminal charges for fraud

5.3 Your Warranty and Representations

By listing a device, you warrant and represent that:

  • You are the legal owner of the device
  • You have the right to sell the device
  • The device is not stolen, lost, or reported missing
  • The device is not locked, blacklisted, or blocked
  • All information provided is accurate and truthful
  • The device condition matches your description
  • You have removed all personal data and accounts from the device
  • You have the authority to complete the sale

6. Pickup and Cancellation

6.1 Pickup Scheduling

  • You must schedule pickup through the app
  • You must be present at the scheduled time and location
  • You must provide accurate pickup address
  • You must have the device ready for inspection
  • You must provide valid government-issued ID for verification

6.2 Cancellation Policy

  • You can cancel pickup before the scheduled time through the app
  • No cancellation charges apply
  • If you cancel after agent arrival, you may be charged for agent time
  • Multiple cancellations may result in account restrictions
  • We reserve the right to cancel if device doesn't match description
  • We reserve the right to cancel if device is stolen, lost, or locked
  • We reserve the right to cancel if you cannot prove ownership

7. Limitation of Liability

To the maximum extent permitted by law, Cellup shall not be liable for:

  • Any loss or damage to your device before pickup completion
  • Payment delays due to incorrect bank account information provided by you
  • Any consequences of providing false or misleading information
  • Price adjustments based on actual device condition
  • Transaction cancellation due to fraud or verification failure
  • Indirect, incidental, or consequential damages
  • Service interruptions or technical issues

Our total liability shall not exceed the amount paid for your specific device transaction.

8. Termination

We may terminate or suspend your account and access to our services:

  • For violations of these Terms
  • For fraudulent activities or attempted fraud
  • For providing false information
  • For selling stolen or unauthorized devices
  • For multiple failed verification attempts
  • At our sole discretion, with or without cause

Upon termination, your right to use our services will immediately cease, and all pending transactions will be cancelled.

9. Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

  1. First, through our in-app support system
  2. Then, through direct communication via email at support@Cellup.in
  3. Finally, through the exclusive jurisdiction of the courts in Srinagar, Jammu and Kashmir, India

You agree to submit to the exclusive jurisdiction of the courts in Srinagar, Jammu and Kashmir for any disputes. All disputes will be governed by Indian law.

10. Intellectual Property

All content, features, and functionality of our services are owned by Cellup and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or use our content without permission.
